WARNING NOTICE

NOTICE IS HEREBY GIVEN to the TRADE AND PUBLIC that ENAGIC (MALAYSIA) SDN BHD ( 971103-W) a company incorporated in Malaysia and having its place of business at No. Unit 25-6 & 27-6, 6F, The Boulevard Mid Valley City, Lingkaran Syed Putra, 59200 Kuala Lumpur is currently the registered proprietor for the following trademarks:

1. “KANGEN WATER” under Trade Mark Registration No. 2016007354 in respect of Bottled water ( not for medical purposes); mineral water ( beverages) and natural mineral waters ( not for medical purposes); drinking water; natural water (not for medical purposes); waters (beverages); aerated water; aerated drinks and beverages (non-alcoholic); isotonic beverage; non-alcoholic beverages all included in class 32.
2. “KANGEN WATER” under Trade Mark Registration No. 2010019251 in respect of apparatus (machines) for filtering water; water distributing apparatus (machines); water processing machines; water separators; all included in class 7.
3. “KANGEN WATER” under Trade Mark Registration No. 2010019261 in respect of household tap water filters; showers; air purifying apparatus and machines; water ionizers pipes (parts of sanitary installations);water distribution installations; water purification installations; water generators, namely generators for household purposes for producing and dispensing clean water; water intake apparatus ; water supply installations; water treatment apparatus; all included in class 11.
4. “KANGEN WATER” under Trade Mark Registration No. 2010019262 in respect of Commercial information and advice for consumers (consumer advice shop); marketing information; providing information, including online, about advertising, business management and administration and office functions; retail services in relation with water ionizers and other health related items; all included in class 35.

 (The mark “KANGEN WATER” hereinafter collectively referred to as “the Trade Marks” and the goods and services described above shall be collectively referred to as “the Products and Services”).

FURTHER NOTICE IS HEREBY GIVEN to the TRADE AND PUBLIC that ENAGIC (MALAYSIA) SDN BHD is also the common law proprietor in Malaysia of the said Trade Mark used in relation to and associated with the Products and Services by reason of the extensive promotional and marketing activities.

FURTHER NOTICE IS HEREBY GIVEN to the TRADE AND PUBLIC that ENAGIC (MALAYSIA) SDN BHD. reserves all rights to and will not hesitate to initiate all necessary and immediate action including both criminal and/ or civil legal proceedings to protect its legal rights against any person, firm or company who sells, offers for sale, promote, advertise and/or assists others to do likewise of any of the Products and Services bearing the Trade Marks, or any mark which is deceptively confusing and colourably similar thereto, without the lawful authority or consent of ENAGIC (MALAYSIA) SDN BHD.

The TRADE AND PUBLIC are requested to notify ENAGIC (MALAYSIA) SDN BHD. immediately of any of the abovementioned acts.
